People Booking Agreement

1. Adults only

People Booking is for age-verified adults (18+). Both the client and the creator must be verified before a request can be sent or accepted.

2. The booking

Role, performance type, audience size, duration, date, venue and price are agreed inside the App (request → accept, decline or counter). Only the terms shown in the accepted request apply.

3. Prohibited conduct; stay in the App

The prohibited content and conduct rules in the Private Room Agreement also apply here. Do not take payment or contact off the platform.

4. Payment, cancellation and no-shows

The creator gets 70% of the gross amount, and all fees come out of that share. The App keeps 30%. Cancellation, refund and no-show rules are as in section 6 of the Private Room Agreement. For in-person events the creator's stated notice period also applies.

5. Independent contractors; taxes

Creators are independent contractors, not employees of the App, and they are responsible for their own taxes.

6. In-person events

The App does not arrange, supervise, attend, insure or vet venues, travel or offline meetings. To the extent permitted by applicable law, participants are responsible for in-person events they arrange. Organisers are responsible for venue safety, permits and their own insurance.

7. Moderation and termination

As in section 9 of the Private Room Agreement.

Platform role (hosting provider)

Hear Voice Sync ("the App") is an online platform that hosts content and tools supplied by users. Within the meaning of the EU Digital Services Act (Regulation (EU) 2022/2065, Article 6, "hosting"), the App is an intermediary service provider. It is not a party to any arrangement, session, performance or conversation between users. It does not employ, endorse, supervise or vet users, and it does not guarantee that any session will happen or what its outcome or quality will be.

Own risk; offline meetings

Users are responsible for their own statements and conduct and for their dealings with each other; HVS provides the technical tools for communication. To the extent permitted by applicable law, HVS is not responsible for other users' conduct. That includes any offline or in-person meeting, event or performance that comes out of a contact made in the App. The App does not arrange, supervise, attend or vet offline meetings or venues. Meet in public places, tell someone you trust where you are, and never share your home address or financial details.

No warranties

To the maximum extent permitted by applicable law, the service is provided "as is" and "as available", without any warranty, express or implied. That includes fitness for a particular purpose, uninterrupted availability, and the accuracy of user profiles, ratings or age/identity checks. Age verification reduces risk. It does not guarantee who a person is.

Limitation of liability

To the maximum extent permitted by applicable law:

1. The App, its owners, officers, staff and contractors are not liable for the conduct of any user, on or off the platform, or for its consequences. This covers physical, emotional, financial and reputational consequences, as well as loss of data, income or opportunity.
2. Any liability of the App that cannot be excluded but can lawfully be capped is limited to the fees the App actually received (its 30% share) for the specific transaction that gave rise to the claim.
3. The App is not liable for indirect, incidental, special, consequential or punitive damages.

What this does NOT limit. Nothing in this agreement excludes or limits any liability that cannot be excluded or limited under applicable law. In particular, it does not limit:

(a) liability for death or personal injury caused by the App's own negligence;

(b) liability for fraud, gross negligence or wilful misconduct (intent);

(c) the mandatory rights of consumers under EU law (including Directive 93/13/EEC on unfair terms) and under Albanian law (including the Consumer Protection Law); or

(d) any other liability that the law does not allow to be limited.

Where a consumer law makes a clause unenforceable, that clause applies only as far as the law allows.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless the App, its owners, officers, staff and contractors from third-party claims, losses and reasonable costs (including legal fees) that arise from (a) your breach of this agreement, (b) your content, or (c) your conduct towards other users, on or off the platform. This does not apply where the loss was caused by the App's own fault.

Release of claims

To the maximum extent permitted by applicable law, you release the App, its owners, officers, staff and contractors from claims arising from disputes or interactions between you and other users. If a law requires that a release of unknown claims must be expressly waived, you waive that protection only as far as the law permits.

Assumption of risk

By ticking the assumption-of-risk box you confirm that you understand the risks of live interaction with people you may not know, including any offline meeting, and that you voluntarily accept those risks.

Safety, reporting and emergencies

• Report and Block are available on every profile, room, booking and message. Reports are reviewed by moderators, and accounts can be restricted or terminated.
• Leave any room at any time. Never let anyone pressure you.
• Emergencies: if you or someone else is in danger, contact local emergency services immediately (112 in the EU and Albania). Hear Voice Sync is not an emergency service and cannot dispatch help.

Severability

If any provision is found invalid or unenforceable, it is limited to the minimum extent necessary and the rest of the agreement remains in force.
