Private Room Agreement
1. Adults only
Private rooms are only for adults who are 18 or older and age-verified in the App (date of birth plus a provider check). Both participants must be verified before a room can be requested, accepted or joined. Accounts that we know are under 18 cannot see private-room features.
2. Consent
Every participant takes part voluntarily and can leave at any time. Ending a session early does not cancel the payment terms in section 6.
3. Prohibited content and conduct
The following are prohibited: illegal content; any sexual content involving minors (reported to the authorities); sexual content of any kind in rooms; harassment, bullying, hate speech, threats or incitement to violence; doxxing (sharing someone's personal information); impersonation; and spam or scams.
4. Stay in the App
Do not ask for or offer off-platform payments, contact details or meetings in order to get around the App. Messages that attempt this may be blocked automatically.
5. Recording
HVS never records, transcribes, analyses with AI, exports or uses private-room audio for training. Recording, capturing or sharing the other person's voice or the conversation without their explicit consent is prohibited and may be illegal where you are. HVS cannot technically prevent someone from recording with another device. Report it if it happens.
6. Payment terms
You pay the price agreed in the App, in advance, through the App's payment system. The creator receives 70% of the gross amount. All processing and store fees are deducted from that 70%. The App keeps 30%.
- Cancellation: a request can be cancelled free of charge before the creator accepts it. After acceptance, refunds follow the creator's cancellation policy shown in the request (default: full refund up to 24 h before the start, 50% afterwards).
- No-show: if the creator does not show up, the client is refunded in full. If the client does not show up within 10 minutes, the creator is paid.
- Technical failure caused by the App: full refund.
Refunds are processed back to the original payment method.
7. Independent contractors
Creators act as independent contractors. The App is a platform and is not the employer, agent or partner of any creator or client.
8. Taxes
Creators are responsible for declaring and paying their own taxes, social contributions and VAT on their earnings. The App may issue statements or tax forms where the law requires.
9. Moderation, reporting and termination
The App may monitor reports, remove content, end rooms, withhold payouts that are under investigation, and suspend or terminate accounts that breach this agreement or the community rules.
Platform role (hosting provider)
Hear Voice Sync ("the App") is an online platform that hosts content and tools supplied by users. Within the meaning of the EU Digital Services Act (Regulation (EU) 2022/2065, Article 6, "hosting"), the App is an intermediary service provider. It is not a party to any arrangement, session, performance or conversation between users. It does not employ, endorse, supervise or vet users, and it does not guarantee that any session will happen or what its outcome or quality will be.
Own risk; offline meetings
Users are responsible for their own statements and conduct and for their dealings with each other; HVS provides the technical tools for communication. To the extent permitted by applicable law, HVS is not responsible for other users' conduct. That includes any offline or in-person meeting, event or performance that comes out of a contact made in the App. The App does not arrange, supervise, attend or vet offline meetings or venues. Meet in public places, tell someone you trust where you are, and never share your home address or financial details.
No warranties
To the maximum extent permitted by applicable law, the service is provided "as is" and "as available", without any warranty, express or implied. That includes fitness for a particular purpose, uninterrupted availability, and the accuracy of user profiles, ratings or age/identity checks. Age verification reduces risk. It does not guarantee who a person is.
Limitation of liability
To the maximum extent permitted by applicable law:
- The App, its owners, officers, staff and contractors are not liable for the conduct of any user, on or off the platform, or for its consequences. This covers physical, emotional, financial and reputational consequences, as well as loss of data, income or opportunity.
- Any liability of the App that cannot be excluded but can lawfully be capped is limited to the fees the App actually received (its 30% share) for the specific transaction that gave rise to the claim.
- The App is not liable for indirect, incidental, special, consequential or punitive damages.
What this does NOT limit. Nothing in this agreement excludes or limits any liability that cannot be excluded or limited under applicable law. In particular, it does not limit:
(a) liability for death or personal injury caused by the App's own negligence;
(b) liability for fraud, gross negligence or wilful misconduct (intent);
(c) the mandatory rights of consumers under EU law (including Directive 93/13/EEC on unfair terms) and under Albanian law (including the Consumer Protection Law); or
(d) any other liability that the law does not allow to be limited.
Where a consumer law makes a clause unenforceable, that clause applies only as far as the law allows.
Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless the App, its owners, officers, staff and contractors from third-party claims, losses and reasonable costs (including legal fees) that arise from (a) your breach of this agreement, (b) your content, or (c) your conduct towards other users, on or off the platform. This does not apply where the loss was caused by the App's own fault.
Release of claims
To the maximum extent permitted by applicable law, you release the App, its owners, officers, staff and contractors from claims arising from disputes or interactions between you and other users. If a law requires that a release of unknown claims must be expressly waived, you waive that protection only as far as the law permits.
Assumption of risk
By ticking the assumption-of-risk box you confirm that you understand the risks of live interaction with people you may not know, including any offline meeting, and that you voluntarily accept those risks.
Safety, reporting and emergencies
- Report and Block are available on every profile, room, booking and message. Reports are reviewed by moderators, and accounts can be restricted or terminated.
- Leave any room at any time. Never let anyone pressure you.
- Emergencies: if you or someone else is in danger, contact local emergency services immediately (112 in the EU and Albania). Hear Voice Sync is not an emergency service and cannot dispatch help.
Severability
If any provision is found invalid or unenforceable, it is limited to the minimum extent necessary and the rest of the agreement remains in force.
Governing law (placeholder)
Governing law and courts will be stated here once the operator details are added. Mandatory consumer-protection rules of your country of residence always continue to apply.
